Third Amended Bill of Review Filed; Trial Holds for December 2, 2026

Proposed — not Texas law The SAFE SAPCR Act is draft legislation. It has not been introduced, has not passed either chamber, and is not in effect. Nothing on this page describes a rule a Texas court applies today.

The operative pleading was amended to correct one date, and the court’s docket confirms the December 2 setting

The short version.

  • The plaintiff filed a Third Amended Bill of Review, file-stamped October 26, 2026. It replaces the Second Amended Bill of Review and states that it corrects one date and makes no other change.
  • A proposed order granting the Third Amended Bill of Review was filed the same day. A proposed order is a draft for the judge to consider, not a ruling, and nothing in the record shows the court has signed it.
  • A fourth and a fifth supplemental exhibit list were filed on October 20 and October 26, 2026.
  • The clerk’s docket sheet confirms the October 19 entry: the case is preferentially set for trial on December 2, 2026 at 1:30 p.m., and the parties are to mediate before that date.
  • Nothing has been decided. No evidence has been heard, the bill of review has not been ruled on, and the August 2024 order remains in effect.

What Changed Since the Last Update

The October 20, 2026 update reported the October 19 setting from the setting itself, and said it would be revised if the docket entry differed. The docket has since been read, on October 25, 2026, and it matches. This update adds that confirmation and the filings made since October 19. All of them were filed by the plaintiff. Nothing here reflects a ruling on the merits.

The Docket Entries for October 13 and October 19

The District Clerk’s docket sheet, read on October 25, 2026, records two entries that bear on the trial setting:

A deputy court reporter’s statement, filed October 19, 2026, certifies that a court reporter worked the setting in this case that day.

This update does not report on mediation beyond what the court’s docket entry says. Mediation in Texas is confidential (Texas Civil Practice and Remedies Code § 154.073), and this site will report only whether it took place and whether it resolved the case.

The Third Amended Bill of Review

An amended pleading replaces the one before it, so the Third Amended Bill of Review is now the live pleading that will be tried. It was submitted on the evening of October 25 and file-stamped by the clerk on October 26, 2026. In its own words, the amendment “corrects the date in paragraph 12 and makes no other change.” It asks for the same relief as the Second Amended Bill of Review: that the August 20, 2024 order in Cause No. 202417675 be set aside and that case be returned to the docket for a trial on the merits.

What the bill of review says happened is what the pleadings allege. They are verified by the plaintiff and denied by the respondent, and no court has made any finding on them. The case study summarizes those allegations with the same caveat.

The same day the plaintiff filed a proposed order granting the Third Amended Bill of Review. It follows the proposed order for the Second Amended Bill of Review that was accepted on October 12. A proposed order states what the filing party asks the court to sign; it is not a ruling, and nothing in the record reviewed for this update shows that the court has signed it.

Supplemental Exhibit Lists

The plaintiff filed a Fourth Supplemental Exhibit List on October 20, 2026 and a Fifth Supplemental Exhibit List on October 26, 2026, each adding exhibits for the December 2 bench trial to the lists filed in October. This site does not describe exhibit contents. Listing an exhibit is notice that a party expects to offer it; whether it is admitted is decided at trial.

What Is Still Pending

Nothing in the clerk’s docket read of October 25, or in the clerk’s filing notices received through November 1, 2026, shows a filing by the respondent or a further order of the court since the October 19 setting. Until a court signs a new order, the order signed in August 2024 governs the children’s conservatorship and possession.
