What Changed Since the Last Update

The September 4, 2026 update reported the Second Amended Bill of Review, a mediation proposal, and non-party records noticed under Rule 205.2. Since then the proceeding has moved through further ordinary pre-trial steps. Nothing in this update reflects a ruling, and no court has made any finding on the merits.

The Three Motions

Each was filed on September 8, 2026, accompanied by a proposed order, and each was accepted by the clerk the same day. A proposed order is a draft submitted with a motion for the judge's consideration; it carries no effect unless and until a judge signs it.

• Motion to Refer Case to Mediation and, in the Alternative, Motion to Waive Mediation. This follows the mediation proposal described in the previous update, and asks the court either to order the referral or to excuse the requirement.
• Motion to Modify the Discovery Control Plan. A discovery control plan sets the schedule within which discovery is conducted. A motion to modify one asks the court to adjust that schedule.
• Motion for Judicial Notice of This Court's Records in Cause Nos. 202353496 and 202417675. Judicial notice is a procedure by which a court may recognise its own records without separate proof of their authenticity. Both cause numbers are already identified on this site's public records page.

Non-Party Records

A witness subpoena issued in this cause was returned executed on September 2, 2026. A further Request for Issuance of Service was accepted on September 10, 2026.
