The short version.

  • Four filings were accepted on September 28, 2026: a request to appear remotely; a response to a nonparty's motion for protection; a request for settings and for an expedited ruling on mediation; and a supplement to the September 8 motion for judicial notice.
  • On September 29, 2026, a Notice of Mediation Unavailability and Renewed Request for Waiver of Mediation was accepted.
  • As of the most recent docket read, on September 27, 2026, no motion had been ruled on or set for hearing, and no order had been signed in this cause since December 29, 2025. The September 28 and 29 filings came after that read.
  • The trial setting has not moved. Trial remains set for October 19, 2026 at 10:00 a.m. in the 311th District Court.

What Changed Since the Last Update

The September 11, 2026 update reported three motions filed September 8: on mediation, on the discovery control plan, and for judicial notice. This update covers the filings made since then. The September 28 and 29 filings are reported from the clerk's notices that each was accepted. Nothing here reflects a ruling, and no court has made any finding on the merits.

Filed September 28, 2026

Each of the following was filed by the plaintiff and accepted by the clerk. The first three were each accompanied by a proposed order. A proposed order is a draft submitted for the judge's consideration; it has no effect unless and until a judge signs it.

Filed September 29, 2026: Mediation

A Notice of Mediation Unavailability and Renewed Request for Waiver of Mediation was filed and accepted, with a proposed order. The pleadings allege that the Harris County Domestic Relations Office had no mediation date available before the trial date.

The court's standing trial-scheduling policy requires mediation before trial unless the court waives it. The September 8 motion asked the court to refer the case to mediation or, in the alternative, to waive it. This notice renews the request for a waiver. Whether mediation is waived rests with the court.

The docket read of September 27, 2026 showed three further entries after the last update. A nonparty filed a motion to quash a subpoena and for protection on September 17, 2026, and a response was filed the same day. A nonparty witness subpoena was returned executed on September 18, 2026. A motion for leave to modify the discovery period was filed on September 21, 2026.
