The short version.
- On the evening of October 7, 2026, the plaintiff submitted eleven filings: witness disclosures, two requests for remote witness testimony, a motion for temporary orders, an exhibit list and a supplemental exhibit list, and four proposed orders.
- Six were accepted on first review on October 8. Five were returned for correction: three proposed orders for an incomplete signature block (Texas Rule of Civil Procedure 57) and two exhibit lists for page size (Rule 21(f)(8)). All five were corrected, refiled and accepted on October 8, 2026.
- On October 10, 2026, a Second Supplemental Exhibit List was submitted. At publication it was awaiting the clerk's review.
- As of the most recent docket read, on September 27, 2026, no motion had been ruled on or set for hearing. The October filings came after that read.
- The trial setting has not moved. Trial remains set for October 19, 2026 at 10:00 a.m. in the 311th District Court.
What Changed Since the Last Update
The October 1, 2026 update reported five filings accepted on September 28 and 29, including a renewed request to waive mediation. No filing was made between October 1 and the evening of October 7. This update covers every filing submitted from October 7 through October 10, 2026, as reported in the clerk's electronic-filing notices: what was submitted, which filings were returned, the reason the clerk gave, and how each was corrected. Nothing here reflects a ruling, and no court has made any finding on the merits.
Filed October 7 and Accepted on First Review
Each of the following was submitted on October 7 and accepted by the clerk on the morning of October 8, 2026. A proposed order is a draft submitted for the judge's consideration; it has no effect unless and until a judge signs it.
- Supplemental Disclosure and Trial Witness List. Identifies the witnesses the plaintiff expects to call at trial.
- Second Supplemental Disclosure and Trial Witness List. Adds one witness.
- Two Requests for a Witness to Testify by Remote Means. Filed under Texas Rule of Civil Procedure 21d, which governs participation in court proceedings by remote means. Both witnesses live outside Texas. Consistent with this site's existing practice, witnesses are not named.
- Proposed Order Permitting Witness to Testify by Remote Means, for the first of the two requests, submitted under a general document code.
- Motion for Temporary Orders Pending Trial on the Merits. Filed under Texas Family Code § 105.001. It asks that temporary orders be considered if the court grants the bill of review, pending a trial on the merits of the underlying case.
Returned for Correction, and How Each Was Fixed
The clerk reviews every electronic filing for form before accepting it. A return is a request to correct and resubmit; it is not a ruling, and the clerk invites refiling with the same docket date. Five October 7 submissions were returned on the morning of October 8. Each was corrected and refiled that day, and each refiled version was accepted.

Texas Rule of Civil Procedure 57 requires a party without a lawyer to sign each pleading and state an address, telephone number and email address. Rule 21(f)(8) requires electronically filed documents to be formatted for letter-size (8.5 by 11 inch) paper. Both returns concerned the form of the documents, not their content.

A Second Supplemental Exhibit List was submitted on October 10, 2026 (Envelope 121029400). At publication the clerk had not yet completed its review. This update will not describe it as accepted until the clerk's notice says so.

Nothing Has Been Ruled On
As of the most recent docket read, on September 27, 2026, the clerk's Settings record showed no hearing set on any motion, and the Judgments/Events record showed no order signed in this cause since December 29, 2025. The filings described above came after that read and are reported from the clerk's filing notices. This update makes no claim about any ruling after September 27.
A filing that has been accepted has been received; it has not been granted, denied, or considered. A filing that was returned has not been rejected on its merits.
